Mario Nicolás Bandiera came to St. Edward's University in January as an exchange student from Buenos Aires, Argentina. The 21-year-old computer information science major and Stevie Ray Vaughan fan said in a campus profile that he looked forward to furthering his studies during his semester in Austin while soaking up the local culture.

But Bandiera was found dead in his Teresa Hall dorm room Feb. 21 of what an autopsy later found were complications of a ruptured appendix.

Now St. Edward's faces a lawsuit by Bandiera's parents that claims the school did not do enough to help their son, particularly by informing him that his student health insurance would cover an emergency room visit.

The university denies negligence.

"Mario's death was a sad and unfortunate event on our campus — as it is any time we lose a member of our campus community. We believe that once fully reviewed, the facts will show that St. Edward's was not negligent in its response to this student and that this was an unusual and tragic circumstance," spokeswoman Mischelle Diaz said in a statement.

The university requires exchange students to attend an orientation program that includes a session on health and wellness, Diaz said.

The lawsuit, filed on June 14 in state District Court in Travis County, has few details about the events surrounding Bandiera's death. Lawyer Jay Winckler , who represents the student's parents, Mario A. Bandiera and Monica Susana Kosik , said he hopes to learn the specifics about what happened through the lawsuit.

They are seeking unspecified damages.

Winckler said in an interview that on Feb. 18 or 19, Bandiera's friend, Paul Rambaud , told a front desk clerk that Bandiera was ill. Winckler said that the clerk told Rambaud, a freshman from France, that if Bandiera is badly sick, he should go to the hospital.

Rambaud, who could not be reached for comment last week, told the clerk that Bandiera did not think his health insurance would cover a hospital visit, Winckler said.

"I think somebody should have gone up (to Bandiera's room) and said, 'Insurance will cover you,'" Winckler said.

Argentina has a three-tiered health care system in which everyone is guaranteed care. Foreign students may be unfamiliar with the American health care system, Winckler said, and the university should do more to inform them of what their insurance covers.

Bandiera tried to go to the campus infirmary over the weekend, but it is closed on those days, Winckler said. Bandiera was found dead Monday morning.
